# Appealing a traffic fine

**In short:** Appealing a traffic fine: we look for a defect that defeats the fine — notification, signage, speed camera calibration, time limits — check the deadline and file submissions or an appeal. We handle it ourselves from start to finish, with professionals from our network, with a written quote before we start and your case visible in your client area. We ask for the full ticket or notice, the camera photo if there is one and the vehicle registration document.

### WHAT IS INCLUDED AND WHAT IS NOT PROMISED

Many fines are quashed because of how they were processed, not because of what happened on the road. What decides it is the deadline: twenty calendar days for submissions from notification of the charge and one month for an appeal from notification of the penalty (articles 95 and 96 of the consolidated Road Traffic Act, Royal Legislative Decree 6/2015).

What it includes: review of the penalty file and search for defects; drafting and filing submissions or the appeal; tracking and notifying you of the outcome. What it does not include: we cannot guarantee it is quashed: where the offence is properly processed and evidenced we tell you so and recommend paying at the discount. The fine (with or without the reduction) and any enforcement surcharges are paid by the client to the authority.

#### DOCUMENTS YOU WILL NEED

- The penalty notice or full notification.
- Photographs or camera capture if any.
- Vehicle registration document.

#### INDICATIVE TIMING

We answer your enquiry within 1 working day and send the written quote within 2 working days.

Once your documents are complete, we prepare the file between 2 and 5 working days.

The authority has one year from the start of the procedure to decide and notify; after that it lapses. Meanwhile we monitor the file and the deadlines for submissions and appeals.

See [the pricing page](https://iberfacil.es/en/pricing) for how we charge this kind of matter.

### How it works

1. **WE IDENTIFY THE EXACT PROCEDURE** We look at the notice and tell you whether you are still in time to make representations, to appeal or already in enforcement, and whether the file has a flaw worth raising.
2. **DOCUMENT LIST AND QUOTE** We ask for the full ticket or notice, the camera photo if there is one and the vehicle registration document. Price agreed before writing.
3. **FILING AND RECEIPT** We draft the representations or the appeal and file them through the traffic authority or the town hall that issued the fine, with a receipt.
4. **TRACKING AND CORRECTIONS** We follow the file and tell you the outcome. If it is rejected, we tell you plainly whether to pay or go on.

#### What to have at hand

- The penalty notice or full notification
- Photographs or camera capture if any
- Vehicle registration document

### Frequently asked questions

DO I LOSE THE DISCOUNT BY APPEALING?

If you pay at the reduced rate you give up the right to make submissions and the procedure is closed; the only route left is the court, within 2 months (art. 94 of the consolidated Road Traffic Act). If you make submissions, you lose the reduction. We tell you what is worth it given the amount and the licence points.

WHAT IF I WAS NEVER NOTIFIED?

A notification defect can defeat the fine; it has to be proved and we review it.

THEY ARE TAKING MY LICENCE POINTS.

The points are challenged with the penalty. If the appeal succeeds, they are restored.
