Cancelling debts you can no longer pay

We assess whether you meet the requirements for discharge of unpaid liabilities and run the procedure through to cancellation of the dischargeable debts.

Personal insolvency and debt discharge

What is included

  • Merits review with an inventory of debts and assets
  • Filing the petition and running the full procedure
  • Payment plan or liquidation, depending on the route that fits

What is included and what is not promised

Personal insolvency cancels debts, but not all of them and not for everyone: it requires good faith, and some debts are not discharged. The first step is an honest assessment of whether your case fits, because starting a procedure that will not end well only adds cost.

What it includes: merits review with an inventory of debts and assets; filing the petition and running the full procedure; payment plan or liquidation, depending on the route that fits. What it does not include: not all debts are discharged: public debts and maintenance have their own rules and we explain them before we start.

Documents you will need

  • A full list of debts with creditor, amount and age.
  • Employment history, payslips or benefits and tax returns.
  • Deeds or contracts for any assets you hold.

Indicative timing

We answer your enquiry within 1 working day and send the written quote within 2 working days.

Once your documents are complete, we prepare the file between 10 and 25 working days.

The procedure is usually measured in months; final discharge may depend on completing a multi-year payment plan.

See the pricing page for how we charge this kind of matter.

How it works

Estimated duration: 25 days.

  1. Merits and deadlines

We draw up an inventory of your debts and assets and tell you whether you meet the requirements for discharge and by which route.

  2. Professional and quote

We ask for the list of creditors, the debt contracts, your income and your assets. Lawyer and court agent assigned; staged quote.

  3. Pleadings and evidence

We file the insolvency application and process the procedure until discharge or the payment plan.

  4. Hearing and judgment

We follow the payment plan if there is one and remind you of each obligation until the final discharge.

What to have at hand

  • A full list of debts with creditor, amount and age
  • Employment history, payslips or benefits and tax returns
  • Deeds or contracts for any assets you hold

Frequently asked questions

Is tax debt cancelled?

Only partly and within limits. We give you the specific figure in the assessment before you decide.

Will I lose my home?

It depends on the route and on the home's value against the mortgage. It is analysed case by case.

Will I come off the credit blacklists?

After discharge, removal can be requested. It is part of closing the file.
