You have been dismissed and the clock is running

We review the letter and the settlement, calculate the compensation due and file the conciliation request and claim within the twenty working days.

Dismissals and challenges

What is included

  • Reading the dismissal letter and the settlement
  • Calculating length of service and compensation for that type of dismissal
  • Conciliation request and claim before the employment court

What is included and what is not promised

The deadline to challenge a dismissal is twenty working days from notification (article 59.3 of the Workers' Statute), and it cannot be recovered. Before signing the settlement it is worth knowing what you are signing: a settlement accepted without reservation makes everything afterwards much harder.

What it includes: reading the dismissal letter and the settlement; calculating length of service and compensation for that type of dismissal; conciliation request and claim before the employment court. What it does not include: we cannot guarantee the dismissal is ruled unfair or void: that is for the court.

Documents you will need

  • Dismissal letter or, if verbal, the date and how you were told.
  • Employment contract and its amendments.
  • Recent payslips and the settlement, signed or unsigned.

Indicative timing

We answer your enquiry within 1 working day and send the written quote within 2 working days.

Once your documents are complete, we prepare the file between 2 and 5 working days.

Conciliation is listed within weeks; without agreement, the employment court hearing usually takes months.

See the pricing page for how we charge this kind of matter.

How it works

Estimated duration: 5 days.

  1. Merits and deadlines

We read the dismissal letter and the settlement before you sign anything and calculate the compensation due according to the type of dismissal.

  2. Professional and quote

We ask for the letter, the contract, the latest payslips and the settlement. Employment lawyer assigned; price in writing.

  3. Pleadings and evidence

We file the conciliation request within the limitation period and, if there is no agreement, the claim before the employment court.

  4. Hearing and judgment

We accompany you to the conciliation and the trial, and explain the judgment: reinstatement, compensation or back pay.

What to have at hand

Frequently asked questions

Should I sign the settlement?

You can sign marking it "not in agreement". Before signing outright, ask us: it takes five minutes.

How much am I owed?

It depends on the type of dismissal and your length of service. We calculate it from your payslips before claiming.

What if my temporary contract was a sham?

It can convert to permanent and change the compensation. We review it against the contract.
