What is included
- Review of the documents and calculation of principal and interest
- Initial petition and its filing
- Tracking through to the payment order or the opposition
We file the initial petition with the documents evidencing the debt and follow the procedure through to payment or opposition.
The order for payment procedure is the fast route for monetary debts evidenced in writing: if the debtor neither pays nor opposes within twenty days (article 815 of the Spanish Civil Procedure Act), enforcement follows. Its effectiveness depends almost entirely on how the debt is evidenced in the initial petition.
What it includes: review of the documents and calculation of principal and interest; initial petition and its filing; tracking through to the payment order or the opposition. What it does not include: if the debtor opposes, the matter becomes a declaratory procedure, which is separate and quoted apart.
Invoices, delivery notes, contracts or debt certificates.
Proof of delivery or of the service provided.
Full details and address of the debtor.
We answer your enquiry within 1 working day and send the written quote within 2 working days.
Once your documents are complete, we prepare the file between 3 and 8 working days.
Once the petition is admitted, the debtor has 20 working days to pay or file an objection; serving the demand for payment takes between weeks and months depending on the court, and an objection opens the proceedings that match the amount, with their own calendar.
See the pricing page for how we charge this kind of matter.
We check that the debt is in writing, not time-barred and that the debtor can be located: without that the order-for-payment route is useless. Before filing, an attempt to settle with the debtor is required (Organic Law 1/2025, art. 5).
We calculate principal and interest and give you the price of the initial petition. It does not require a lawyer or court agent (Civil Procedure Act, art. 814.2); if there is opposition, they are needed only if the small civil claim exceeds €2,000.
We draft the petition with the documents that prove the debt and file it at the court of the debtor's address.
We follow the payment order: if they pay, we close; if they do not appear, we request enforcement; if they oppose, we tell you which procedure follows and what it costs.
For the initial petition, never (Civil Procedure Act, art. 814.2). If there is opposition, only if the small civil claim exceeds €2,000; and enforcement above €2,000 requires a lawyer and court agent (art. 539.1). We say so from the outset so it does not surprise you.
Enforcement comes to nothing. That is why we check solvency before spending on litigation.
Rent arrears go through eviction or a claim with a professional, not through this service. Community service charges do, and they also have their own privileged route.
People who come for “Order for payment procedure” often need one of these services too. If your case mixes several, it goes in a single file with a single quote.
