What is included and what is not promised

The order for payment procedure is the fast route for monetary debts evidenced in writing: if the debtor neither pays nor opposes within twenty days (article 815 of the Spanish Civil Procedure Act), enforcement follows. Its effectiveness depends almost entirely on how the debt is evidenced in the initial petition.

What it includes: review of the documents and calculation of principal and interest; initial petition and its filing; tracking through to the payment order or the opposition. What it does not include: if the debtor opposes, the matter becomes a declaratory procedure, which is separate and quoted apart.

Do I need a lawyer?

Not always for the initial petition. If there is opposition, yes. We say so from the outset so it does not surprise you.

What if the debtor has no assets?

Enforcement comes to nothing. That is why we check solvency before spending on litigation.

Does it work for rent arrears?
